Overview
These terms explain what to expect when you request a website or work with Web Wizard on a website project. By submitting the Get a Website form and ticking the agreement box, you're confirming you've read, understood, and agree to these terms.
Who Can Enter This Agreement
By submitting a request, you're confirming you're at least 18 years old, or otherwise legally able to enter into this agreement, and that if you're requesting a website on behalf of a business, you're authorised to do so.
How This Works
The Request Process
Filling out the "Get a Website" form is free and does not commit you to anything. Once submitted, you'll be contacted to discuss your project further. Prices shown on the Price Estimator page are rough, general estimates only, calculated on your own device, and not a final quote.
The Project Process
Once a project begins, a website prototype will be built based on what you told us in your Get a Website form, and shared with you for feedback. From there, you can request as many rounds of changes as you need, there's no limit, until you're genuinely happy with the result. Once you are, an invoice will be sent, and the finished files are handed over once it's paid.
Revisions vs. Changes of Scope
Unlimited revisions means unlimited refinement of the website we agreed to build together: changes to layout, wording, colours, images, and similar details based on what you told us in your Get a Website form. If you decide partway through that you'd like something substantially different, extra pages, new features, or a different type of website altogether than what was quoted, that's a change of scope rather than a revision. We'll always let you know before doing that extra work if it's likely to affect the price or timeline, and no extra charge is applied without you agreeing to it first.
Client Responsibilities
To keep your project moving, we'll need reasonably timely feedback on the prototype, and accurate information about your business and what you want the website to do. If content like photos or specific wording isn't ready yet, that's fine, clearly-labelled placeholders can be used in the meantime and swapped in later.
Delays
Timelines given are estimates, not guarantees. Things like illness, school commitments, technical issues, or other circumstances outside our control can affect how long a project takes, we'll keep you updated if that happens.
If a Project Goes Quiet
If we don't hear back from you for 5 days or more while a project is in progress, for example, no response to a prototype or requested feedback, we may treat the project as paused. Picking back up is no problem, just get in touch and we'll continue from where we left off.
Money
Payment
No payment is required upfront or during the project. Payment is only due once you've confirmed you're 100% happy with the finished website. At that point, an invoice is sent through Stripe, and the final website files are handed over once that invoice has been paid.
Refunds
Because payment is only ever requested after you've confirmed you're fully happy with the finished website, refunds aren't offered simply because you've changed your mind after paying. If you're not happy with something, raise it before paying, changes can still be made at that point free of charge.
None of this affects your rights under the Australian Consumer Law. Our services come with guarantees that can't be excluded, including that they'll be provided with due care and skill and be reasonably fit for the purpose you told us about. If those aren't met, you're entitled to a remedy regardless of anything in this section.
What's Not Included
Unless otherwise agreed, hosting, domain registration, and ongoing maintenance after the project is complete are not included as part of a standard project. See the FAQ section on our homepage for more detail on what's currently offered.
Your Content, Ownership & Our Work
Content You Provide
Any text, photos, logos, or other content you give us to use on your website, you're confirming you own it or have the right to use it. If a copyright or trademark claim ever comes up because of content you provided, that's on you to sort out, not us.
Ownership
Until an invoice has been paid, the website remains the property of Web Wizard. Once paid in full, ownership of the finished website files transfers to you.
Using Your Project as an Example
Once a project is finished, we may feature it in our Portfolio or Showcase pages, and on our social media, as an example of our work. If you'd rather your project wasn't shown publicly, just let us know and we won't include it.
Third-Party Platforms & Compatibility
Your website is built to work properly at the time it's handed over. We're not responsible for issues that come up afterwards because of your own hosting provider, domain settings, or third-party platform changes, or because browsers and web standards change over time.
No Guarantee of Compliance
Unless specifically agreed in writing beforehand, we don't guarantee your website meets any particular accessibility standard (such as WCAG) or industry-specific regulation. If compliance with a specific standard matters for your business, let us know before the project begins so it can be discussed.
If Things Change
Cancellations
Because payment is only ever taken once you're happy with the finished result, you're free to cancel a project at any point beforehand at no cost. If you'd like to cancel, just get in touch and let us know. Once an invoice has been paid, the project is considered complete and finalised.
Our Right to Decline or End a Project
We're also free to decline a project, or stop working on one, at any point, for example if the website would involve anything illegal, harmful, or seriously inappropriate, or if we're not being treated reasonably. If that happens before you've paid anything, you won't be charged.
After Your Website Is Handed Over
For 7 days after your finished website is handed over, we'll fix any genuine bugs or things that aren't working as intended, free of charge. After that, or for anything that's a new request rather than a fix (extra pages, new features, design changes), that's treated as new work, and we're happy to help, just as a separate paid job.
Legal Details
Confidentiality
Anything you share with us about your business as part of a project is kept confidential and only used to complete your website.
Independent Contractor
Web Wizard operates as an independent contractor. Working with us doesn't create an employment relationship, partnership, or joint venture between you and Web Wizard.
Limitation of Liability
Web Wizard will do its best to deliver a high-quality website, but makes no guarantees about specific business outcomes (such as sales, enquiries, or search engine rankings) resulting from the website. To the extent allowed by law, our total liability for any claim relating to a project is limited to the amount you paid for that project.
Entire Agreement
These terms, together with the answers you provide in the Get a Website form, make up the whole agreement between you and Web Wizard for the project, and replace any earlier discussions about it. Any changes to the agreed scope need to be confirmed in writing between us before they apply.
Changes to These Terms
These terms may be updated from time to time. The version on this page is always the current one. For a project already in progress, the terms that applied when you submitted your request continue to apply, unless we agree otherwise.
Severability
If any part of these terms is found to be invalid or unenforceable, the rest of the terms still apply.
Governing Law & Disputes
If a disagreement ever comes up, we'll always try to sort it out directly and reasonably first before anything more formal. These terms are governed by the laws of Queensland, Australia.
